CONSIDER NOTICE OF REVIEW REQUEST: PLOT 2, ACHNACAIRN, NORTH CONNEL (REF: 24/0004/LRB)

Minutes:

The Chair, Councillor Gordon Blair, welcomed everyone to the meeting.Ìý He explained that no person present would be entitled to speak other than the Members of the Local Review Body and Mr Jackson, who would provide procedural advice if required.

 

He advised that his/her first task would be to establish if the Members of the Local Review Body felt that they had sufficient information before them to come to a decision on the Review.

 

Councillor Brown said that after viewing the site she would like more clarification on the options available to the Local Review Body.Ìý She said that she understood the definition of backfill but was not understanding it in the context of this development as it seemed to be a different standard to the other housing developments that they had looked at.

 

The Chair advised that the Local Review Body would require to have another meeting to put forward a proposal to accept the application with conditions attached.

 

Councillor Hardie advised that he agreed with Councillor Blair and Councillor Brown.

 

Mr Jackson advised that if the Local Review Body were minded to approve the application they may wish to request model conditions and reasons that could be applied to an approval and seek advice on competent motion to approve the application.

 

Councillor Brown said that she understood the reasons for backfilling but the site didn’t look like other backfill sites in the area and would like the opportunity to seek to prepare a motion to grant the application.

 

Mr Jackson advised that this would be a departure from planning policy and advised Councillor Brown that she would require to consider the position around how that particular site may be acceptable and why she thought the policy did not apply to that site. He advised that she could seek assistance in preparing a Motion once she had formed some ideas around her justification for departure from planning policy. Mr Jackson explained the timescales around asking for further information in respect of model conditions and reasons.

 

Councillor Brown sought confirmation that this was planning permission in principle and if approved the applicant would require to apply for full planning permission.Ìý Mr Jackson advised that this would be the case.

 

Councillors Blair and Hardie advised that they agreed with Councillor Brown seeking the opportunity to prepare a motion to approve the application.

 

Decision

 

The Â鶹Ãâ·Ñ°æ and Bute Local Review Body –

 

1.     agreed to request, from the Planning Authority, model conditions and reasons that could accompany an approval; and

 

2.     agreed to continue consideration of the application to allow for the opportunity to seek to prepare a competent motion to approve the application.
